Common Orthopaedic Injury Claims

  • Missed Fractures – This may occur as a result of failure to undertake an x-ray or perhaps a failure to interpret an x-ray correctly.
  • Failure to diagnose – For instance a condition of the bone called osteomyelitis.
  • Negligent hip or knee replacement surgery – Was this undertaken by a specialist orthopaedic surgeon who had undertaken such operations before and was experienced?  Were the right components used and were they fitted correctly?  Was replacement surgery appropriate and will it require revision in the future? Mistakes in this surgery can lead to a severe loss of function and a discrepancy in leg length requiring modified footwear to compensate.
  • Increased risk of infection – Was this correctly assessed and was the correct medication (such a prophylactic antibiotic cover) used at the correct times?
